Jet Airways today said that the newly-constituted National Aviators Guild (NAG) was under legal obligation not to proceed on strike when conciliation proceedings were in process under the Industrial Disputes Act.
The company said it had received a letter from the Regional Labour Commissioner (Central) on August 27 which also said Jet Airways is a public utility service and striking work when conciliation proceedings were on would attract legal action.
In view of this clarification, and this confirmation by the government, the airline assured its guests that going forward it was confident of maintaining normalcy in its flight schedules and operations. Jets pilots said if talks with the Labour Commissioner (Central) failed, they could go on strike. Neither can the union go on strike nor can the company sack anyone seven days before or after the reconciliation talks. But if talks fail then we can definitely strike after seven days, said Girish Kaushik, president,NAG.
The confrontation between Jets pilots and its management began on August 5 after the company sacked two senior pilots for forming a trade union. The airline operates over 380 flights daily to 63 destinations within India and overseas and has over 800 pilots of which 600 have joined the National Aviators Guild.
