The Supreme Court Tuesday refused to entertain a petition by a journalist,seeking cancellation of bail of former Gujarat minister Amit Shah in the Soharabuddin Sheikh and Tulsiram Prajapati fake encounter cases. We cannot entertain a writ petition. You should have filed an application. We cannot permit this petition to be treated as an application, said a Bench of Justices H L Dattu and S J Mukopadhaya. It said the matter relating to bail to Shah had already been disposed of by the apex court and if the petitioner sought to raise certain contentions,he will have to file a proper application in the earlier matter. This prompted advocate Kamini Jaiswal,who appeared for petitioner Pushp Kumar Sharma,to seek permission to withdraw the petition with a liberty to file an appropriate application in the bail matter. The Bench accepted her request. Sharma claimed he had conducted a sting operation against BJP MPs Prakash Javadekar and Bhupendra Singh Yadav as they allegedly tried to impede investigation in the encounter cases and protect Amit Shah.
