SC notice to Maharashtra,CBI on Dosa bail plea

The Supreme Court issued notices to the Maharashtra government and the CBI on a bail plea by Mustafa Ahmed Dosa.

The Supreme Court on Monday issued notices to the Maharashtra government and the CBI on a bail plea by Mustafa Ahmed Dosa,an accused in the 1993 Mumbai blasts case. He is seeking bail in a TADA case pending against him in Ratnagiri.

Dosa had absconded after the Mumbai blasts and his trial was separated from that of the others. He was extradited from Dubai in 2003. He has approached the apex court challenging the order of a special TADA court,rejecting his bail plea.

At the most we can ask the special court to expedite the hearings. You are not an ordinary accused. You are a proclaimed offender. The court has noted that it would be a danger to the society if you are granted bail. There is no ground for release at this stage, a Bench comprising Justices P Sathasivam and A K Patnaik said.

The court,however,was convinced later to issue a notice after it was informed that the apex court itself had earlier granted him bail in a case relating to smuggling of arms and ammunition allegedly in connection with the Mumbai blasts.

Senior advocate P H Parekh,appearing for Dosa,said the accused was facing trial in several TADA cases at Jamnagar,Porbandar and Ratnagiri areas and all relate to the 1993 Mumbai blasts.

He said the special court refused bail to Dosa for the Ratnagiri case while he had been granted bail in another case and until he is granted bail in all cases he cannot be released. The case will now be taken up once the court reopens after the vacation.
