The Supreme Court on Thursday criticised the Gujarat government for adopting an adversarial attitude toward proceedings in the Sohrabuddin Sheikh fake encounter case,in which former minister Amit Shah is an accused.
Dont forget that the state has been taking adversarial attitude and sometime adversarial attitude turns into hostile attitude…three persons were killed in cold blood and the matter needs to be investigated. More than once we said state should have shown anxiety to come to the bottom of the things, said a bench of justices Aftab Alam and Ranjana Prakash Desai.
The bench later reserved order on the CBIs plea to cancel bail to Shah and shift the trial outside Gujarat.
We are going to pass a very brief order, the bench said,adding it would also consider Shahs plea that he be allowed to visit Gujarat in view of the upcoming Assembly elections.
The court had granted bail to Shah on the condition that he would not go to Gujarat. But on August 28,the court had indicated that while it may not be averse to allowing Shah to visit Gujarat in view of the polls,it would like the trial to be shifted to Maharashtra.
The CBI argued that Shah couldnt be placed on a higher pedestal than other accused in the Sohrabuddin case who have been denied bail.
Countering the CBIs contention,his counsel Ram Jethmalani said Shah was ready to accept any condition to continue his bail.
