SC slams frivolous litigation by govt officials

The Supreme Court on Wednesday came down heavily on rise in frivolous litigation by government officials across the country.

The Supreme Court on Wednesday came down heavily on rise in frivolous litigation by government officials across the country and regretted such officers were not held accountable for waste of public money.

“For almost two decades, courts across the country have witnessed a surge in frivolous litigations by public authority which results in wastage of public money that could have been utilised for deciding meaningful litigation,” said a Bench led by Justice G S Singhvi.

“It is perhaps the officers are not held accountable for the frivolous litigation,” the Bench added as it imposed a penalty of Rs 1 lakh on Chennai Port Trust. The trust was slapped with the cost for denying an employee’s widow compassionate appointment since 2000 and taking her case up to the apex court.

The Bench pulled up the trust for challenging the Madras High Court order once passed by the single judge Bench and then upheld by a division Bench directing for her appointment.
